Terms of Service

1. General regulations
1.1. Dirhost.net provides for the Customer (the Services Provider and the Customer are collectively referred to below as the "Parties") web hosting, domain name registration, and the related services (referred to below as the "Services"), and the Customer uses the Services in accordance with these Terms of Service.
1.2. When starting to use the Services, the Customer acknowledges and agrees with these terms and conditions.

2. Payment information
2.1. After receiving the bill, the Customer in 1 (one) day must pay the Fees for the Services that are set forth by the Services Provider and posted at dirhost.net (referred to below as the "Fees for the Services"), if the Parties have not agreed otherwise.
2.2. The Services Provider reserves the right to change the Fees for the Services by giving notice to the Customer, that would be applied in the case of the renewal of the Services and if new Services are ordered.

3. Responsibilities of the Services Provider and the Customer
3.1. The Service Provider starts providing the Services to the Client within no longer than 1 (one) working day when the Client fulfills the requirements set out in rule 2.1.
3.2. Within 24 hours after receiving a notice from the Customer about a failure in the provision of the Services, the Services Provider is responsible for undertaking a set of actions to eliminate these interruptions.
3.3. The Services Provider is not responsible for storing the Customer's data after the termination of the Services.
3.4. The Services Provider is responsible for giving all rights to the registered domain name to the Customer. All domain names are registered on behalf of the Customer.
3.5. The Services Provider is not responsible for the content, illegal software, or information on the Customer's website.
3.6. The Services Provider is not responsible for the failures of the servers which are beyond the control of the Services Provider (including fire, flood, war, failure of electricity service, terrorist activities, crime, and other force majeure).
3.7. All the information about the Customer that the Services Provider collects is confidential and may be provided to third parties only with the Customer's consent, except for the cases prescribed by the laws.
3.8. The Customer is responsible for providing the correct contact information and within 7 (seven) days notifying of any changes in this information.
3.9. The Customer is responsible for paying the Fees for the Services if the server resources have been exceeded.
3.10. The Customer is responsible for informing the Services Provider of noticed failure in the provision of the Services.
3.11. The Customer is responsible for not using any server-side chat scripts and not using the servers for sending mass emails (spam).
3.12. The Customer is responsible for not using the servers of the Services Provider for any activity which is directly or indirectly associated with the illegal use of copyrighted material (unauthorized distribution of music, video, software, etc.).
3.13. The Customer is responsible for not using the servers of the Services Provider for any advertising and other illegal purposes, which may infringe the rights of other users, as well as violate the laws or international agreements.
3.14. The Customer is responsible for not engaging in any activity that causes a high load on the servers of the Services Provider and that requires a disproportionate amount of resources (CPU usage, memory usage, bandwidth, data transfer rate (traffic speed), TCP connections, MySQL database connections, etc.), including, but not limited to, use of highly active scripts. The activity that causes the high load on the server is when more than 30 percent of the same type of resources (eg. CPU usage) are used up.
3.15. What concerns the relations with third parties, the Parties assume individual responsibility. The Parties are not liable for indirect loss.
3.16. The Services Provider is not responsible for periodic data backups and potential data loss during a server failure. The customer is responsible for making and storing backup copies.
3.17. The Services Provider may at any time suspend the operation of the hosted website if it is targeted by a DDoS attack and this would affect the operation of the entire shared server.

3.2.1 Unauthorized activities

  • Participation in DoS, DDoS attacks (as a source, intermediary or target).
  • Compromising the security of computer systems.
  • Hosting or distributing pirated content.
  • Hosting or promoting Public Proxy Services.
  • Mass email sending mail.
  • Hosting pornographic or erotic content.
  • Dissemination of disinformation.
  • Hosting or distribution of vulnerable, unmaintained software.
  • Any prohibited activity.
  • If the content of the user's website does not meet the ethical or moral norms and principles accepted in society - the services are canceled without a separate warning.

4. Operation and termination of the Services
4.1. The ordered Services are started to be provided when the Customer fulfills the requirements set out in regulation 2.1.
4.2. The Services Provider may at any time terminate the Services if the Customer breaches any provision of these Terms of Service.
4.3. Unpaid services are first suspended after 1 day, and after 30 days they are completely terminated and all former client files on the server are removed.

5. Other regulations
5.1. All disputes arising shall be considered in the way of negotiations. In case of not succeeding in coming to an agreement in the way of negotiations, the dispute is to be resolved in accordance with the laws.
5.2. The Services Provider reserves the right to make changes and additions to these Terms of Service by giving prior notice to the Customer.
